1. Acceptance of these Terms
These Terms of Service ("Terms") are a legal agreement between you and PRP Regeneration Specialists LLC ("PRP Regeneration Specialists," "we," "us," or "our"), located at 216 NW 135th Way, Suite 10, Jonesville, FL 32669. They govern your use of https://www.prpregen.com (the "Site"), our online forms and booking tools, and our email and SMS/text messaging programs (together, the "Services").
By accessing the Site, submitting a form, booking an appointment, or opting in to our communications, you agree to these Terms and to our Privacy Policy (https://www.prpregen.com/privacy-policy), which is incorporated by reference. If you do not agree, do not use the Services.
Age restriction. You must be 18 years of age or older to use the Services, to submit a form on the Site, or to opt in to our SMS/text messaging program. By using the Services you represent that you are at least 18 years old and that all information you provide is accurate and current. A parent or legal guardian may use the Services on behalf of a minor patient.
2. Medical Information Disclaimer
The content on the Site, including descriptions of PRP therapy, shockwave therapy, prolotherapy, hormone optimization, medical weight loss, aesthetic treatments, and other services, is provided for general informational purposes only. It is not medical advice, does not create a provider-patient relationship, and is not a substitute for evaluation, diagnosis, or treatment by a licensed health care professional.
A provider-patient relationship is formed only when you are evaluated by one of our licensed providers and accepted as a patient. Individual results vary; descriptions, images, and testimonials on the Site do not guarantee any particular outcome.
If you are experiencing a medical emergency, call 911 or go to the nearest emergency room. Do not use the Site, our contact form, or text messaging to seek emergency care.
3. Appointments, Cancellations, and Payment
Submitting a booking request through the Site does not guarantee an appointment. Appointments are confirmed only when our office contacts you to confirm the date and time.
We ask for at least 24 hours' notice to cancel or reschedule. Late cancellations and missed appointments may be subject to a fee as disclosed at the time of booking or in our office policies.
Many of our services are elective and are not covered by insurance. Payment is due at the time of service unless other arrangements are made in writing. Pricing shown on the Site, if any, is subject to change without notice and is confirmed at the time of your consultation.
4. SMS / Text Messaging Terms and Conditions
4.1 SMS program description and messaging use cases. PRP Regeneration Specialists LLC offers an SMS/text messaging program to patients and prospective patients who opt in. When you provide your mobile phone number and consent, you agree to receive text messages from PRP Regeneration Specialists for the following use cases: (a) transactional and informational messages, including appointment confirmations, appointment reminders, scheduling changes, account notifications, billing and payment notices, and customer care responses to your inquiries; and (b) promotional and marketing messages, including special offers, new services, events, and health and wellness updates, only if you have separately opted in to marketing messages. Messages may be sent using an automated system.
4.2 How to opt in. You can opt in by checking the applicable consent box on our website contact form at https://www.prpregen.com/contact-us, by providing your mobile number and consent to our staff in person or by phone, or by texting a keyword to our business number. Consent to receive text messages is not a condition of purchasing any goods or services.
4.3 Message frequency. Message frequency varies depending on your appointments and interactions with us.
4.4 Message and data rates. Message and data rates may apply. Standard messaging rates from your wireless carrier will apply to messages you send and receive. Contact your wireless carrier for details about your text messaging plan.
4.5 How to opt out. You can cancel the SMS service at any time. Text STOP to any message you receive from us, and we will send you one final SMS message confirming that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, text START or sign up again through one of the opt-in methods above, and we will start sending SMS messages to you again.
4.6 Support and contact information. If you are experiencing issues with the messaging program, text HELP to any message for assistance, call us at (352) 260-4061, or contact us using the information in Section 7. You can also reply HELP to any message to receive our contact information.
4.7 Carrier liability disclaimer. Wireless carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your wireless carrier and network operator.
4.8 Privacy. Your mobile phone number and SMS opt-in consent will not be shared with or sold to third parties or affiliates for their marketing purposes. Information collected through the SMS program is handled in accordance with our Privacy Policy, available at https://www.prpregen.com/privacy-policy.
4.9 Your mobile number. You represent that you are the owner or authorized user of the mobile number you provide and that you will notify us promptly if that number changes or is reassigned.
5. Acceptable Use and Intellectual Property
You agree not to use the Services to submit false or misleading information, impersonate another person, interfere with the operation or security of the Site, scrape or harvest data, transmit malware, or violate any applicable law. We may suspend or terminate your access to the Services for any violation of these Terms.
All content on the Site, including text, graphics, logos, images, videos, and the PRP Regeneration Specialists name and branding, is owned by or licensed to us and is protected by copyright, trademark, and other intellectual property laws. You may view and print pages for personal, non-commercial use. You may not copy, modify, distribute, republish, or create derivative works from Site content without our prior written permission.
If you submit reviews, testimonials, or other content to us, you grant us a non-exclusive, royalty-free, perpetual license to use, reproduce, and display that content in connection with our business, and you represent that you have the right to grant this license. We will not publish any protected health information without your written HIPAA authorization.
6. Disclaimers, Limitation of Liability, and Indemnification
Disclaimer. THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES, OR THAT TEXT OR EMAIL MESSAGES WILL BE DELIVERED WITHOUT DELAY. This disclaimer applies to the Site and electronic communications only; it does not limit our professional obligations in the delivery of medical care.
Limitation of liability. TO THE FULLEST EXTENT PERMITTED BY LAW, PRP REGENERATION SPECIALISTS LLC AND ITS OWNERS, PROVIDERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ELECTRONIC COMMUNICATIONS, INCLUDING DELAYED OR UNDELIVERED MESSAGES. Wireless carriers are not liable for delayed or undelivered messages. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for medical negligence.
Indemnification. You agree to indemnify and hold harmless PRP Regeneration Specialists LLC and its owners, providers, employees, and agents from any claims, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Services, or information you submit that is false or infringes another person's rights.
7. Governing Law, Disputes, Changes, and Contact
Governing law. These Terms are governed by the laws of the State of Florida without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Alachua County, Florida, and you consent to the jurisdiction of those courts. Disputes concerning medical care are governed by applicable Florida law and are not subject to this Section.
Severability and waiver. If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce any provision is not a waiver of our right to do so later.
Changes to these Terms. We may revise these Terms at any time by posting the updated version on the Site with a new effective date. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
Entire agreement. These Terms, together with our Privacy Policy and any patient intake, consent, or financial agreements you sign in our office, constitute the entire agreement between you and us regarding the Services.
